File an objection to his motion and list all the reasons it should not be granted, including improper enlargement of the filed case.

Request a dismissal of his motion for summary judgment and request a summary judgment on your own behalf for a dismissal with prejuidice and sanctions against ASS for abuse of proccess and filing a frivolous and meritless claim.
