In Texas, you keep your house and one car per licensed driver. You might have a shot at keeping the rental properties if you can show that it is your only source of income; however, you would probably loose the rental properties. Speak to that lawyer about it, though.

However, if your only behind on the credit cards and they have not been sent to collections, I would think bankruptcy would be premature. The worst that can happen is a creditor takes you to court and gets a judgement. They can't touch your exempted property. Your rental properties have liens and you are keeping current on the payments. Speak to that lawyer about your non-bankruptcy options.

In fact, a lot of lawyers offer the first consult free, so speak with a lot of lawyers. Remember, its a job interview and you are the one hiring a lawyer!
