Actually, depending on your state, they can freeze a bank account prior to a judgement. But, it takes a court order from a judge. If the plaintiff can show a reason to believe that the defendant will attempt to hide or dispose of assests prior to a trial, a judge may issue a court order freezing those assets. My guess is that they would need good evidence to support the claim before a judge signs the order. But, it is possible. By responding to the hearing notice, the judge can be made aware of extenuating circumstances, like child support.
