Accidental Online Payment Nightmare, What now?

Here's a fun one. In March I mistakenly paid the wrong credit card with my online bill pay in the amount of $364. So I call them on a conference call with my bank BofA and they say they will refund it, it will take 30 days. So i wait 30 days and call and they say they refunded it, i wait alittle longer. Dont get it call back and they say they did on 5/13/04, then they say they will have to contact their banking office and reissue. This same call happens 2 more times with nothing new. Finally today i call and they say the 1st payment was sent to Mitech Check free and i need to call them to get my money. I said well my account number goes with my name and address, it doenst matter who pays my bills, its my account you need to refund me. If you paid the wrong people you need to deal with that. So they told me i need to call the banking office in Iowa, which of course is closed, has no voice mail and is a rotary phone(seriosuly she said that). So I am calling back on monday and fully expect the run around. Anyone know any good laws or things i could throw at them. I can sue them in small claims i assume? I already filed a grievance with the FTC about them. Any help would be greatly appreciated.
