I just found this site and wish I had found it a long time ago because I think I have royally screwed everything up. I had no idea that I have any of the rights that I have been reading about on this site. From what I have read, my situation sounds pretty typical, but here goes. I have been served with arbitration papers from W&A which seems to be how they do business according to everyone. My debt is horribly high and although I am paying some of my credit accounts a little bit here and a little bit there, I am falling further and further behind. three out of 15 are up to date by making the minimum payment each month, and 3 are with W&A right now (MBNA). One card I paid over 100 dollars to this past month that I borrowed so I could order my kid's contacts online because that is cheaper but I turned around and spent it right away on the contacts. Then, a few months really got stupid and took out a couple of payday loans to pay some bills. Well, that has just screwed me up even more. The thing is, I make some pretty good money. If anyone saw my monthly income they would probably tell me to shut up. But I still can't feed my kids sometimes and have to use the food shelf and I never, ever go shopping unless the bottom of their shoes fall out. I am so sorry this has gotten long, but what does bankruptcy court look at? If they see my income I am afraid they will say , she has money and dismiss everything.
