I'm from Rhode Island. This is for a Citibank card that I got a while back. I stopped paying on it because I lost my part-time job in July of 2001. Haven't paid on it since. This account bounced from collection agency to collection agency. Now it is with a lawyer in the area. He originally sent me correspondence at the end of may. A standard collection letter. I just came back from vacation with my parents on the 7th. Now, after going through the mail I see he sent another letter plus there was a Certified letter notice in the mailbox as well from him. The letter he sent was sent 4 days before the certified letter. Enclosed in the letter was a copy of a summons dated the 26th of May (around the time I got my first letter from him). I find this odd, or is this normal? On the summons there are directions to my house and the normal "This is attempt to collect a debt." It is on actual summons forms, because I've seen one before, but it's dated the 26th of May. Then along with the "summons" are two sheets of paper. One looks like a complaint and the other says that a case came before a judge in Rhode Island on the 30th of July (while I was away). That states the I can be served from a sheriff or through the mail. I'm really confused as to what is going on... so here are a few questions I need desprate help with.

1) What is the deal with this summons dated the 26th of May and the court case on the 30th of July. Both of which I never heard of until now. I was never served nor was any member of my family and the summons isn't signed.

2) Should I send validation ASAP?

3) Is the certified letter that is waiting at the post office for me a trick to get me to be served?

4) Should I not pick up the certified letter?

5) I'm going away to grad school in 14 days and it's far far away from home... how would this impact any proceedings againt me?

6) What happens if I get a default judgement? BK time? My only assets are like a hundred dollars in the bank. I don't see what suing me would do as i'm not working.

7) is the SOL up?

THANK YOU!!!
