We have until Thursday to answer the lawsuit...We live in Montana and Unifund's sleazy lawyers are suing my husband for a debt that is a hair's width of being out of SOL...We answered the suit using the SOL defense laid out by Why Chat...but doing some more research, I find that it is against the law for them to bring suit without the debt being validated. They NEVER validated this debt after we requested twice. All they ever sent was a statement from April of 2000 or something like that....no signature or accounting of interest, fees and so forth, and it took them over a year to send that!!!! Should I change the answer and include the fact that the debt was never validated along with the SOL defense? (It has to be included in the answer or we cannot bring it up in court.) I learned that from a previous lawsuit against me. What do you think, guys?
