This is for Florida and Texas. I'll just give you the whole thing.

In Fl. if you wish to sell or refinance your home, and there is a judgment lien against it, you file an affidavit of homestead which provides clear title for 180 days to complete the transaction without having to pay off the judgment lien.

Tx has a different system. Basically, the proceeds from your sale of homesteaded property are exempted from judgment lien IF you reinvest in another home within 6 months.

If you refinance, it can not be MORE than was fianced at the time the judgment was placed.

You would file an affidavit of homestead in Tx. if you are refinancing another property for a higher amount.

So, even if it is liened, you can still sell and you can still refinance.
