I live in Montana and am married. I have a judgment (8/2000) for approx. $7k. My spouse is not a party to the judgment. I am on Social Security Disability and have no attachable assets. Home is totally mortgaged, as are both vehicles. We have furnishings in our home, but nothing of any value. I have no tools or guns. They belong to my husband.
Today I got another letter from the attorney collecting for the creditor ( a leasing company) asking me for proof of Social Security Disability along with a "financial statement" which requests not only information on my income and assets, but those of my husband as well.
I'm relatively certain that without a court order the attorney (creditor) may not require any financial information on me. I know he has no right to ANY information about my husband's income and assets.
He tells me in this letter that the only way his client will discontinue its legal options is for me to verify my Social Security Disability by providing him with a copy my award letter. He then goes on to request a 4 page financial statement.
I have no problem providing them with proof of SSD, but would I have to provide information about my husband in a debtor's exam in court? I have informed this attorney previously that I have no ability to pay because of my situation.
Montana is not a community property state, so how could they possibly take any property besides an old toaster and microwave oven.....???
Thanks for your advice and responses.
