Wow, have they stepped in it !! By actually putting it in writing that they will only cease collections if you settle. MAJOR violation of the FDCPA as they should have ceased collection efforts when they got your FIRST validation letter !!! They are racking up blatant vioaltions of the FDCPA. I would NOT agree to 'paid settled', that's not good. I would insist on total deletion in return for payment. Might be time for an intent to sue or an nutcase letter if you're up to it. If the thing is past SOL I wouldn't pay them anything at all ! At the very least I wouldn't accept their offer as is. If you want to settle this, draft your own settlement offer, otherwise I'd ignore this one. If they're willing to settle for 50%,offer them 35%.
