I have written before and am new to this. I live in florida and am past due on 6 cc for 50k, 180 days..i had been making below minimum payments on these cc. but can no longer continue to do this. Our house is joint and homestead, the checking is jt, with my spouse as primary. 1,2,3 mort. cars financed. everything is current and being paid but the cc. I had to give up something and since they were unsecured they went. I cannot file bk, as i have a partnership asset that i can't loose and use this as part of my living wages..I am sure the next step is ca's, the cc are mbna 15k, discover 7800,am ex 12K, direct merchants 12K chase 3k, 1st card 2k. What can I do to insure against garnishment?, do the ca's try to collect first, and then if they get nowhere does the oc file suit, or does the oc ussually file suit first, then turn over to ca..Also, if there is a hearing for judgement what is the point of asking for validation???and in most cases are judegements awarded to the oc? when is it best to try to settle. I can't now, is it better to settle with oc, at judgement hearing or with ca?? Are there payment plans available? This is really scary, and overwhelming. I have read many of the articels here and also on why chats credit confusion...they are helpful, but to some one whos never been there its nice to know whats coming and to plan ahead..your input would be appreiciated..thanks victory
