what next?

Deep in debt in Texas... 2 direct Merchants cards and one Next card. All have been charged off. DMB is $11000 and $6000 while Next Card is $5000.
I live in Texas, own my home and other then that have only $4000 in my 401k. I tried to work with DMB but they kept changing the agreement. I have not heard from next Card in Months. Sometimes I get 5 calls a day from DMB and each offers a different deal. I now tell them I will do nothing futher until I get a agreement in writing...they say that cannot be done
If I am sued what county or state will it be filed...district or ?. I do not plan on filing BK unless someone tells me its the best option. I have got all my other debts back under control and would rather not start over... What would you do? What can I expect next from DMB and Next Card?
