Capital One???

Ok, here goes. I recently had my credit report ran by a company and on it showed a charge off by Capital One for over $4,000. I called Capital One and they answered the phone as the Westmoreland Agency. I asked if they were a division of Capital One and they said yes. I said, tell me why you are showing me as having a charge off when I don't even have nor have ever had an account with you. She asked where I lived and I told her. She said, I'm sorry, I cannot tell you anything because we are not licensed in your state. I said thank you and hung up.

I know what this is for, this is for something that was charged off in 1999 by another credit card company, the statute of limitations is now up. Capital One has never contacted me in any way, shape or form, I had to contact them.

I guess my question is can they report this as a current account/charged off when they are acting as a collection agency? They make it appear as if they are the original creditor and they are not. I sent out a week ago a DV to Capital One d/b/a Westmoreland Agency and just got the green card back.

ANY ADVICE???
