Let me make an analogy. I lend you $1000, and in the contract I state that if you default, you have to give me your first-born child. You sign the contract.

Do you see the problem here? Maybe you signed that contract, but it can’t be enforced.

The credit card companies are trying to make people waive a fundamental right to a court trial with these arbitration clauses. They can’t do that, even if you’ve signed it.
