You should continue your motion to vacate. I have NO idea, (as I have posted earlier) how a Nunc pro tunc motion could in ANY way be valid in your situation. This particular seldom used motion is for clerical errors that are serious enough to invalidate an existing proceeding.It has NOTHING to do with a failure to properly serve, or in fact ANY error or ommission on the part of the plaintiff. The words, literally translated mean "Now As Then" and are intended to effect a material change in a proceding due to a CLERICAL error. There is, in the case files from Mo. (CAK's State) a case where someone attempted to use this incorrectly and was squashed by the Courts.
