I live in Kansas and filed chapter13 BK recently. I just got a letter from my lawyer that the IRS is objecting to my plan because they say that I had not filed my 97 or 98 taxes and they don't know how much I really owe them. This is the first time they have mentioned this, even though I am fairly certain they are correct. My mental illness, which is now controlled by medication, was really bad those years and I feared filing taxes and did not do so. I know it sounds stupid, but it is the truth. I don't have any W2's left or anything like that. My attorney is requesting a copy of my returns or a reason why I did not file. What do I tell him? And what will happen now? Could this ruin my entire Bk? Can I just drop the IRS from the plan, we owe them like around 300 dollars from last year, and pay them when we can? Can the IRS figure on their own how much I would owe for those two years? Please, if anyone has any info, I would love to hear from you!!!
