Court Victory!!!!! (Kind of Long)

Over a month ago, I received a summons from Flunkie Lawfirm on behalf of Scumbag CA, an assignee of Discover. I consulted with an attorney, and he told me that they couldn't win a judgement on the "evidence" they attached, which was simply a statement with the total dollar amount.

Less than a week later, I received a letter from another CA that said this account had been purchased by them. Took this notice to the attorney and he told me a dismissal was almost certain, since the law firm and CA filing the suit no longer had any legal interest in the account.

He sent in an answer, which included asking that the petion be dismissed and that the Plaintiff would have to pay for our legal fees. (Of course I'm paraphrasing!)

The case was dismissed and the judge awarded us our legal expenses!!!!!!!

The bad news is that the account was sold to A$$ett Acceptence. The first notice we received from them was a warm, friendly letter, welcoming us as customers. (GAG) Ironically, today, on our court day, we got a second notice from A$$ett that wasn't nearly so friendly.

The amount we were sued for was significantly less thatn the amount on the first notice from A$$ett, and this new notice had a higher amount still.

I've heard that the folks at A$$et are, well, a$$e$, and I'm wondering how much collection activity they might utilize to collect on an account that obviously couldn't be legally validated by the law firm that sued us.

Unfortunately, instead of celebrating our victory, I had to take DH to the ER this evening for shortness of breath and chest pains and he's being kept overnight for observation and further testing. I'll be a lot happier about the court victory when I know DH is okay.
