when I became aware my mortgage payment was going to be past due (due to unemployment & medical circumstances) I phoned my mortgage co. to inform them & try to work out payment arrangements BEFORE they called me & before it became 30 days past due (this was sept 25). I thought I had worked out arrangements...they told me I could be 1 month behind (but it would show up on my credit report) I agreed to make a payment on nov 8 (which I did) and call every month if it was still going to be late. Since then I have been getting calls 1-2 times a week informing me my mortgage is past due, I tell the person on the phone that I have made arrangements with the loan counseling dept. & then they will look at my file. They keep asking me the SAME questions every time, which I answer the SAME every time & the very same questions I have answered for the loan counseling dept. IE: my monthly income, can I sell any property to pay this debt, can I borrw money from family, have I contected help agencies etc. ALSO I have told the every time they call that I will call to inform them if my situation changes, if I find a job, if I can pay more, etc. Now they are calling EVERY DAY! I am getting very frustrated, are these repeated phone calls a violation of the FDPCA sec. 1692 d (5)???? and if so, what action can I take? P.S. I DO want to keep my home, and I am TRYING to work this out with them. I do not intend to be more than 30 days late, I do intend to catch up as soon as possible but can not give them a specific time frame until I find employment. I live in Utah. Thank you in advance
