Being Sue for Capital One Credit Card

Hi everyone, I receive a writ from Capital One's Attorney to be answered in Small Claims Court on the 13th of November. This account I have disputed with First Resolution Management Corporation and I have been waiting for them to send me validation. First Resolution sent me a letter stating "This leter is to inform you that First Resolution Investment Corporation is now the legal owner of your outstanding account as noted above." Their letter is dated April 18, 2002. It also goes on to state that this communication is from a debt collector and is an attempt to collect a debt. The writs state that Capital One is suing me not First Resolution. Since First Resolution is the legal owner of this account can Capita One sue me, and since they are debt collectors does this attorney for Capital One have any power or authority to do this. First Resolution stated to me on the phone in April that this account was open in Jan. 1997. I live in Connecticut and believe the SOL is 6 years for Open End Accounts. That makes me just months from SOL. Furthermore the interest rate legally in Connecticut is 8% they are saying 19.80%. What can I use as a Defense. Please respond ASAP.
